Frequently asked questions

How should I write an invention description?

--Write in your own words. Try to be detailed in places where your invention is unique. There is no need for details that have no importance to the invention. It is advisable to provide alternatives provided they are inventive.


Is it mandatory to provide drawings?

-- It depends on the invention. In many cases this is recommended in order to avoid rejection of your patent application on the grounds that it does not describe the invention properly.


Is it better to conceal some of the parts of the invention?

-- Anything that does not appear in the patent application will not be protected by a patent if granted. Another problem that may arise is a rejection or revocation on the grounds that the description of invention is vague.


When do I get protection for the invention?

-- Protection of an invention starts after a patent is granted. One condition for that is that no application for the same invention was filed before the date on which your application was filed. That means you have a priority date.


Is it possible to get an international patent?

-- An International Application (PCT) may be filed but a patent will be granted only in the jurisdiction (state or organization in which several countries are members) in which the application was filed after the end of the international phase.


What is a Provisional Patent Application?

-- In some countries, e.g., the US, it is possible to file a provisional application at significantly lower fees. Such an application is valid for one year but can be converted during the year to a standard application after payment of the full fees.


What happens if someone copies my invention with a minor change?

-- Unauthorized copying of a patented invention, with minor modifications, is considered a patent infringement. It is also not possible to obtain a patent for insignificant changes compared to a published knowledge, e.g,. a published patent application.
